Transforming Our Justice System - Tribunal Panel Composition
On Friday 24 November the Law Society submitted their second response to the 'Transforming Our Justice System' consultation, which focuses on the composition of the tribunal panel. The most fundamental change in the proposals is to introduce a default position to reduce the composition from three judges to one sitting alone.
The Law Society's response focuses on:
- The importance of access to expertise in the cases that currently account for over half of the sitting days of non-legal members – that being the mental health tribunal
- The difficulty in assessing whether a panel will be needed ahead of the hearing
- Comparative issues with using the special educational needs pilot.
The Law Society will also be writing to the MoJ separately with regard to virtual hearings, probate and digitising divorce.
