Road Traffic Accidents Fixed Costs Recovery Appeal

On 23 February the Court of Appeal is due to hear the Iqbal & Anr v. Leek & Anr appeal. The Court will consider whether or not solicitors may be ordered to repay costs received under the Road Traffic Accident Protocol's fixed costs regime where a claim was not pursued beyond stage 1 of the pre-2013 Pre-Acction Protocol for Low Value Personal Injury Claims in Road Traffic Accidents.

Solicitors should be aware of this live case, in which the Law Society has made written submissions on the issues to the Court. It is expected that, once delivered, the Court of Appeal judgment will provide clarity for solicitors in this position.
