Fixed Recoverable Costs
Following last year's publication of Lord Justice Jackson's supplementary report on fixed recoverable costs, the Law Society's Civil Justice Committee has continued its scheme of roundtable meetings to gather the opinions and insight from solicitors in commercial litigation practices.
The supplementary report recommends - among other things:
- Extending fixed recoverable costs across the remainder of the fast track
- Creating a new intermediate track with fixed recoverable costs in cases of up to £100,000
- A voluntary pilot of capped recoverable costs in the business and property court for cases up to £250,000.
Whilst the Ministry of Justice (MoJ) has pledged to launch a consultation in due course based on the contents of the report, the Law Society are actively engaging with the profession to gather views and identify issues and points of contention. This is to ensure a more representative response can be prepared once the MoJ consultation is launched.
